Lebanese Center for Human Rights: LYNCHING IN THE PUBLIC SQUARE

A press release from the Lebanese Center for Human Rights (CLDH) on the barbaric massacre in the Chouf village of Ketermaya, Lebanon.

Recently, a few YouTube videos surfaced by proud members of the Ketermaya community who proudly present the justice done to the "Egyptian murderer" celebrating his killing, lynching and parading around the small mixed, Druze-Sunni village south-east of Beirut. I opted to share with you two videos however which report the incident as "a shameful crime" to avoid stereo-typing the people of Lebanon and the Chouf mountains until I've investigated more to produce a better-informed blog. In this video, of the "awful crims of murdering and lynching an Egyptian in Ketermaya", the YouTube member keeps a faint image of the pre-1979 Iranian flag in the background and two faint photos of Neda [Soltan], the Iranian lady who was tortured, killed and allegedly lynched during the 2009 unrest in Tehran following the country's heavily-contended presidential election. Perhaps the intention was to draw parallels between government repression in Iran and societal barbarism in Lebanon's Ketermaya?

The other video is an LBC news report on the incident criticising the police force for failing to provide security, law and order for neither the innocent, nor the guilty.

Anyhow, as I mentioned, I've intended - and will be blogging more on the weakness of the state, corruption of the police, vigilante justice and barbaric mob/gang action in developing countries drawing parallels between Latin America, Egypt and Lebanon.

But for the time being, here's the statement of CLDH in English, French and Arabic.

LYNCHING IN THE PUBLIC SQUARE: THE VIOLATION OF PRESUMPTION OF INNOCENCE LEADS TO BARBARISM

Thursday, April 29th, 2010, a man arrested the previous day by the ISF for quadruple homicide was brutally lynched in the public square of the village of Ketermaya, while the ISF was trying to bring him back to the crime scene as part of the investigation. Security sources argue that the police was allegedly unable to prevent this crime. The Ministry of Interior has requested an investigation.

We denounce the fact that once more confidential information of a criminal investigation under way has been revealed to the public allowing for this lynching of a suspect.

We denounce the lawless media publications with no journalistic ethics that violate the presumption of innocence by making public "confessions" and "evidence" while relying merely on one source, namely security services who sometimes practice torture to obtain confessions or even fabricate evidence.

We denounce the failure of the security services to protect a person under their care.

We denounce the judicial system, unable to make fair decisions which would enable citizens to have confidence in their Justice.

We ask that the investigation ordered for this act of unprecedented violence be completed and that the security services be tried for the acts they committed, which result from incompetence, vice of procedure and/or criminal intent. We also ask that all the persons who tortured to death this presumed innocent detainee be held accountable for their actions.

We urge the media to stop publishing any information made public illegally by the security services and to respect the presumption of innocence.

We demand that the investigation into the quadruple murder carries on in order to determine the author of the crime, and that the results be revealed by the competent authorities, whatever these results may be.

We call on the judiciary, all judges, but also ministers and MPs, to realize that no peace is possible in Lebanon without a credible justice. It is shocking to note that no reform has yet been introduced in this regards and that the practices from the era of the occupations continue.

LYNCHAGE SUR UNE PLACE PUBLIQUE : LA VIOLATION DE LA PRESOMPTION D’INNOCENCE MENE A LA BARBARIE
Jeudi 29 avril 2010, un homme arrêté la veille par les FSI pour un quadruple homicide a été lynché sauvagement sur la place publique dans le village de Ketermaya, alors que les FSI tentaient de le ramener sur les lieux du crime pour les besoins de l’enquête. Les sources sécuritaires affirment que les policiers auraient été incapables d’empêcher ce crime. Le Ministère de l’Intérieur a demandé l’ouverture d’une enquête.

Nous dénonçons le fait qu’une fois de plus des informations confidentielles sur une enquête criminelle en cours ont été dévoilées au public permettant ce lynchage d’un suspect.

Nous dénonçons les publications médiatiques anarchiques et sans aucune déontologie journalistique qui violent la présomption d’innocence en rendant publics « aveux » et « preuves » en se contentant d’une source unique, à savoir des services de sécurité qui parfois pratiquent la torture pour obtenir des aveux voire fabriquent des preuves.
Nous dénonçons l’incapacité des services de sécurité à protéger une personne sous leur garde.

Nous dénonçons le système judiciaire, incapable de rendre des décisions équitables qui permettraient aux citoyens d’avoir confiance dans leur justice.

Nous demandons que l’enquête ordonnée sur cet acte d’une violence inouïe soit menée à terme et que les services de sécurité soient jugés pour les faits qu’ils ont commis, que ceux-ci relèvent de l’incompétence, du vice de procédure et/ou d’une volonté criminelle. Nous demandons aussi que toutes les personnes qui ont torturé à mort ce détenu, présumé innocent, soient tenues pour responsables de leurs actes.

Nous demandons aux médias de cesser de publier toute information rendue publique illégalement par les services de sécurité et de respecter la présomption d’innocence.

Nous demandons que l’enquête sur le quadruple meurtre se poursuive, pour en déterminer l’auteur, et que les résultats en soient révélés par les autorités compétentes, quels que soient ces résultats.

Nous demandons au système judiciaire, à l’ensemble des juges, mais aussi aux ministres et aux députés, de prendre conscience qu’aucune paix n’est possible au Liban sans une justice crédible. Il est révoltant de noter qu’aucune réforme n’ait encore été engagée dans ce but et que les pratiques de l’ère des occupations se poursuivent.

إعدام تعسفي في ساحة عامّة : إنتهاك لفرضيّة البراءة يؤدّي الى أعمال همجيّة

في نهار الخميس الواقع في 29 ابريل/نيسان 2010 وفيما كانت عناصر من قوى الأمن الداخلي تقتاد رجلاً، أوقفته نهار الأربعاء الى بلدة "كترمايا" بغية تمثيل جريمة اقترفها وأودت بحياة أربعة أشخاص، تجمّع اهل البلدة و أمسكوا به وأعدموه بشكلٍ وحشي في الساحة العامة. وأكّدت المصادر الأمنيّة بأنّ رجال الأمن لم يتمكنوا من الحؤول دون إرتكاب هذا العمل الإجرامي. وطلب وزير الداخليّة فتح تحقيق حول هذه القضية.

وإننا نستنكر أنّ معلومات سرية متعلقة بتحرّ جنائي جاري قد كُشفت للعامة مرة أخرى ما أدى إلى إعدام تعسفي لمشتبه به .

وندين ما نشرته وسائل الاعلام الفوضوية، التي تنعدم فيها الواجبات والأخلاقيات الصحافية، فهي تنتهك فرضيات البراءة بنشرها "اعترافات " و "اثباتات" لا ترتكز إلا على مصدر واحد، ألا وهي القوى الأمنية التي تلجأ أحيانًا إلى التعذيب لانتزاع اعترافات، أو حتى إلى تلفيق أدلة.

وندين فشل القوى الامني في حماية شخص تحت رعايتهم.

كما أننا ندين النظام القضائي، الذي يعجز عن اتخاذ قرارات عادلة قد تسمح للمواطنين بالوثوق في عدالتها.

ونحن نطالب بإجراء التحقيق في ما يخصّ هذا العمل العنيف ضمن المهلة المحددة له، وبمحاكمة عناصر الأمن على الأفعال التي ارتكبوها، سواء كانت تنمّ عن عدم أهليتهم أو عن عيب في الاجراءات و/أوعن رغبتهم في ارتكاب الجرم. ونطالب أيضًا بتحميل الأشخاص اللذين عذبوا وأدوا إلى مقتل المعتقل، هذا المتهم الذي تنطبق عليه فرضية البراءة، مسؤولية أفعالهم.

ونطالب وسائل الإعلام بالتوقف عن نشر المعلومات التي صرّحت بها قوى الأمن بشكل غير قانوني، وبإحترام فرضية براءة المتهم.

ونُطالب أيضًا متابعة التحقيق في الجريمة التي استهدفت أربعة أشخاص بهدف تحديد الفاعل، ونطالب السلطات المختصة بالكشف عن نتائج التحقيق، مهما أتت هذه النتائج.

ونطلب أيضًا من النظام القضائي، ومن مجمل القضاة، والوزراء والنواب أن يعوا أنّ تحقيق السلام في لبنان يشترط تحقيق عدالة تتمتع بمصداقية. ومن المثير للاستياء، أنّ أيّ إصلاحات في هذا الصدد لم تنجز وأنّ الممارسات التي كانت سائدة في فترة الاحتلال، ما زالت مستمرة حتى الآن.
